Federal Judge Orders USCIS to Begin Accepting New DACA Applications

 

A Federal Judge in the Eastern District of New York made a powerful ruling on Friday, December 4th. Judge Nicholas G. Garaufis ordered the Federal Government to begin accepting new DACA applications.

The Judge went as far as to order the government to post on their webpage that they will begin accepting new DACA applications, and he only gave them 3 calendar days to post the notice. The Judge also ordered USCIS to begin accepting advanced parole requests from those currently in the DACA program.

Good News for Potential DACA Recipients & Family Members

While this is amazing news for potential DACA recipients and their families, we must caution the government can always appeal the judge’s decision.

Also, there is a federal case in Texas, which may rule differently on DACA. That case has a hearing on December 22, 2021. (read the order for a hearing here: DecHearingTexasCase
